Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you (and, if you use the Service on behalf of an organization, that organization) and Tyrbo (“Tyrbo,” “we,” “us,” or “our”). They govern your access to and use of the Tyrbo website, web application, desktop app, and browser extension (together, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy and Fair Use Policy.

1. Eligibility & accounts

You must be at least 16 years old and able to form a binding contract to use the Service. You are responsible for the security of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use. If you register on behalf of an organization, you represent that you are authorized to bind it to these Terms.

2. The Service

Tyrbo lets you build and run automations that combine app integrations and browser automation. You are solely responsible for the automations you create, the websites and services they interact with, and the data they process. You must have the right to access and automate any system your workflows touch, and you must comply with those systems’ terms.

3. Subscriptions, credits & billing

• Plans. Paid plans (currently Light at $29/month for 1,000 credits and Pro at $79/month for 4,000 credits) are billed in advance on a recurring basis through our payment processor, Stripe.
• Credits. Credits are consumed by Service activity — for example, building an automation with the AI builder (a one-time charge on confirmation) and running automations (per run). Included credits reset each billing cycle and do not roll over.
• Overage. Usage beyond your included credits is billed as overage at your plan’s per-credit rate ($0.04 on Light, $0.03 on Pro). You may set a hard cap to limit overage.
• Renewals & changes. Subscriptions renew automatically until cancelled. You can upgrade, downgrade, or cancel at any time; changes take effect at the end of the current billing period.
• Taxes. Fees are exclusive of taxes, which you are responsible for where applicable.
• Refunds. Except where required by law, payments and purchased credits are non-refundable.

4. Acceptable use

You agree not to misuse the Service. Prohibited conduct is described in our Fair Use Policy, which is incorporated into these Terms. In short, you must not use Tyrbo to break the law, infringe others’ rights, circumvent technical protections, send spam, or place an unreasonable load on our infrastructure or on the third-party systems you automate.

5. Third-party services

The Service connects to and operates third-party apps and websites that Tyrbo does not control. Your use of those services is governed by their own terms, and you are responsible for complying with them. Tyrbo is not responsible for the availability, accuracy, or conduct of third-party services.

6. Intellectual property

The Service, including its software, design, and brand, is owned by Tyrbo and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. You retain all rights to the automations, prompts, and data you create or provide (“Your Content”). You grant us a limited license to host, process, and transmit Your Content solely to operate the Service for you.

7. Beta features

We may offer features labeled beta, preview, or experimental. These are provided “as is,” may change or be withdrawn, and may be less reliable than generally available features.

8. Suspension & termination

You may stop using the Service and cancel at any time. We may suspend or terminate your access if you breach these Terms or the Fair Use Policy, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends and we may delete Your Content in accordance with our Privacy Policy.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT AUTOMATIONS WILL ALWAYS RUN SUCCESSFULLY.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TYRBO WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

11. Indemnification

You agree to indemnify and hold Tyrbo harmless from claims, damages, and expenses arising out of your use of the Service, your automations, or your violation of these Terms or applicable law.

12. Changes to the Service or Terms

We may modify the Service or these Terms. If we make material changes to these Terms, we will update the “Last updated” date and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws applicable at Tyrbo’s principal place of business, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction, except where mandatory local law provides otherwise.
